I am thrilled about the recent S.C.O.T.U.S ruling on the Chevron Deference case. In my opinion, this takes power away from the government and gives it back to the People! The current way our laws are passes is the idiots do their thing, and give the law to agencies who then determine what was meant in the law and create their own rules. Depending on who is in power of each agency or who the reigning political party is, these "rules" vary, become inconsistent, or are off on how the law was intended.
Going forward the law is going to have to address all of the different rules rather than have the bias of who is in power, however with the caveat, one political party with the majority to pass laws will still be able to pass the rules they want, hopefully this leads to more bipartisan compromises, I am tired of the gridlock that our political system has become, they are supposed to compromise and serve ALL of their people, not just the ones they like, how often do you feel your leaders actually compromise?
Both Trump and Biden allowed these type of rules to be created, Trump with the ATF, and Biden with the Department of Labor. I am trying to point out that this applies to ALL, both sides of the political spectrum. It should trickle down to local governments too. The Constitution is clear on how laws get passed, and we are governed by the laws we pass, not the rules or policies any agency creates for us. Remember law trumps all, no policy or rule can trump what the law says. I see this issue pop up a lot in 1st Amendment Auditors and the work they do. A lot of local governments try saying their "policy" states x, and the auditors stand their ground with law on their side, and when their rights get violated, the taxpayers foot the bill.
I kind of think we need to make all elected leaders go through a class on how laws are made, and that we are held accountable to laws not policies. if you graduate from high school you should know this stuff, but I guess some people didn't pay attention to that part of their education. It will very interesting to see our next legislative sessions unfold and how many laws get passed with this ruling? We need to vote out all the incumbents too, always have new and fresh ideas coming in. Does this ruling mean that every government needs to go back and create laws for the current "rules" and "policies" we are supposed to be abiding by?
This ruling will have a ripple effect across every level of government.
